Phase 2, Part 1: Public Stormwater Facilities

The update allows limited flexibility for public stormwater facilities while continuing to protect the City’s most sensitive natural resource areas.

Prior to the adoption of the environmental overlay, or natural resources overlay code in 2020, placement in natural resource areas was permitted. The current code only allows 10% encroachment, without a higher, more costly level of review. The update would not permit a public stormwater pond to encroach into high value resource areas and would not allow encroachment of privately maintained stormwater facilities.
